Preparing Your Estate Plan: What You Need to Know

March 22, 2023 by Brandon McGee

Preparing your estate plan is an important step in securing your financial future and ensuring that your assets are distributed according to your wishes. Here are five steps you should keep in mind when preparing your estate plan:

Step 1: Know the basic components of an estate plan. An estate plan typically includes a will or trust, powers of attorney, and a living will or advanced healthcare directive. These documents outline how your assets will be distributed after you pass away, who will make financial and legal decisions on your behalf if you become incapacitated, and your end-of-life healthcare preferences.

Step 2: Understand the legal requirements for creating an estate plan. Estate planning laws can vary by state, so it’s important to understand the legal requirements for creating an estate plan in your specific jurisdiction. An experienced estate planning attorney can help you navigate this process.

Step 3: Consider the tax implications of your estate plan. Depending on the size and composition of your estate, there may be tax implications that need to be considered. An estate planning attorney or financial advisor can help you understand these implications and develop a plan to minimize tax liabilities.

Step 4: Choose the right executor or trustee. The executor or trustee is responsible for administering your estate and ensuring that your wishes are carried out. It’s important to choose someone who is trustworthy, responsible, and capable of handling the responsibilities that come with this role.

Step 5: Review and update your estate plan regularly. As your life circumstances change, such as getting married, having children, or experiencing a change in financial situation, it’s important to update your estate plan to reflect these changes. This can ensure that your assets are protected and distributed in the way that you intend.

In summary, preparing your estate plan requires a solid understanding of the basic components of an estate plan, legal requirements, tax implications, choosing the right executor or trustee, and regular reviews and updates. By following these steps, you can provide peace of mind for yourself and your loved ones. An experienced estate planning attorney can guide you through the process and help ensure that your estate plan meets your specific needs and goals.

Client Review
May 25, 2021

Brandon McGee is knowledgeable, experienced and professional regarding Estate Planning. The entire process of multiple meetings to establish our input, draft and sign documents and fund the Trust were well organized and clearly explained. At completion, we were presented with a very well organized binder with the documents (both paper and electronic) and lists for future action.  In short, we find Brandon McGee and his staff to be competent, professional and friendly. ~ Brian C.
